A modernised ECT reflecting EU values and objectives: a multilateral framework promoting energy investment in a sustainable way?

In recent years, the Energy Charter Treaty has come under immense scrutiny and criticism for allegedly protecting fossil fuel industry undercutting sovereignty. As a key stakeholder in modernisation process, EU been determined to reform investment protection standards investor–state dispute settlement mechanism include new provisions on sustainable development climate change. However, after three years of protracted negotiations, proposed needs appropriately address escalating global challenges regarding action development. With member states such as Poland, Spain Netherlands announcing their intention withdraw, future is hanging balance. This article focuses whether reformed fit purpose, from an perspective, impacts absence meeting core objectives alignment with Paris Agreement, this questions can deviate only multilateral framework energy sector EU’s policy goals.
